JAMES C. DRIGGS, ESQ. v. ANY UNKNOWN HEIRS AT LAW, DEVISEES AND/OR OTHER SUCCESSOR IN INTEREST OF BARBARA O. ZAYER, and ANY OTHER PERSON OR PERSONS CLAIMING ANY OWNERSHIP OR LIEN INTEREST IN THE HEREIN DESCRIBED REAL PROPERTY and their successors in title or interest, including any heirs, devisees, assigns, surviving spouse and lien creditors, whose names and whereabouts are unknown and who are made parties defendant by the general description of PARTIES UNKNOWN. ORDER OF PUBLICATION
CAME THIS DAY the Petitioner, James C. Driggs, Esq., having provided evidence satisfactory that Barbara O. Zayer (hereinafter the “Decedent”) died interstate December 23, 2022 with unknown heirs, that Petitioner has used diligent effort to discover heirs without success and therefore there are Parties Unknown who have an interest in the Estate of Barbara O. Zayer, deceased.
That Petitioner desires to qualify as Administrator of the Estate of Barbara O. Zayer, deceased, and, in addition, to be granted the fiduciary powers described Virginia Code §64.2-105 and §64.2-106, including without limitation the authority to sell the parcels in Henrico County, Virginia known as 8400 Fordson Farm Lane, Henrico VA 23231 (Parcel 819-684-6961) and Parcel 819-684-6961.002.
THEREFORE, it is hereby ORDERED that Parties Unknown having an interest in the Estate of Barbara O. Zayer, deceased, including heirs, devisees, assigns, surviving spouses or lien creditors of the said heirs, or any of them, with their respective consorts, which persons are generally described as PARTIES UNKNOWN, do appears herein and protect his or her interests within fifty (50) days after entry of this Order, specifically, on or before May 4, 2026.
And it is further ORDERED that this Order be published once a week for four (4) successive weeks, pursuant to Virginia Code Section 8.01-317 in The Henrico Citizen as a newspaper of general circulation in or around Henrico, Virginia.
And this matter is continued on the docket.
